GENERAL TERMS OF SALE


  1. Terms
    Sales of our products are subject to present general conditions, which prevail over any other terms of purchase, unless there is a formal written agreement between Estiluz and the client.

  2. Prices
    All prices published in the Price List are recommended retail prices without taxes.Bulbs are not included with the exception of the items marked accordingly.

  3. Project Registration
    For the protection of our distributors and agents, all projects should be registered with our Estiluz office.

  4. Discounts
    The standard discount granted to a distributor does not apply in case of projects registered by another distributor or agent. The distributor shall contact Estiluz to inquiry about these projects and ask for pricing

  5. Special Orders
    All orders including non-standard products must be pre-paid at the confirmation of the order.

  6. Payments
    All past due invoices are subject to interest penalties at current legal rates.

  7. Transportation
    1. International: Freight will be paid by the client. Freight due (FCA Barcelona or EXW). Estiluz will not be responsible for any damages that may occur in transit. Exceptions: Consult specific policies per country. 
    2. Spain and Portugal: Freight allowed on all orders equal or above 450€ net before taxes when the goods are shipped to the dealer or its client in case of projects. All others will be charged a 15€ fee with the exception of Canarias, Formentera, Ceuta, Melilla, Madeira, Azores and delivery to private addresses, where transportation costs will be calculated individually.

  9. Order confirmations and cancellations
    Orders must be sent in writing, either by mail, email or fax. Estiluz is not responsible for any mistakes on orders that have not been received in writing.Orders will not be canceled unless we receive notice from the customer prior to shipment.Special orders cannot be canceled.

  10. Claims and returns
    Estiluz will only accept claims filed within 15 days after shipment of merchandise. Returned merchandise will not be accepted unless prior arrangements have been made with our Customer Service department. Handling and Repair fees will apply if the product is not received in perfect conditions and its original packaging.All returns due to reasons for which Estiluz cannot be held responsible, will be charged 20% restocking fee and original freight.

  11. Delivery
    If the merchandise received is not in good condition or does not match the packing slip, it should be noted on the packing slip prior to signature. Estiluz should also receive a written notice in the following three days.

  12. Property Rights
    The merchandise will remain property of Estiluz until it is paid in full. Estiluz reserves the right to retrieve all unpaid goods without advanced notice. If that is the case, the client is responsible for all costs involved with the return and assumes the risk of damage.

  13. Warranty
    Our manufactured products (except for bulbs) are guaranteed against any manufacturing defects for two years from date of delivery. The warranty is limited to replacement of defective material and does not include any labor, expenses or damages contingent or incidental thereto. This warranty does not apply to products damaged due to accident, tampering, misuse or abuse.

  14. Modifications
    Estiluz reserves the right to modify and/or discontinue any products illustrated in this price list.

  15. Disputes
    Any disputes are subject to arbitration in equity in Barcelona, according to the Spanish law.
